Hello

I am about to  buy an apartment and wanted to know if  anybody knows if the town council would approve of a kitchen in a basement? Would the town council approve it as a habitual area?   The original property was 3 different business premises.  The use of these was changed by the original seller from business premises to an apartment with a permit obtained from the town hall and the 3 properties were unified to a single property  

 You walk through the front door at ground level where there is a bedroom and ensuite on your right and then a staircase down to the basement where there is a living room, kitchen, bedroom and bathroom.

If I decided to sell in a few years would there be a problem.

I havn't managed to find the answer yet so thought I would put it on the forum.

Denise, I had a bathroom fitted into a basement room (previously non habitual) To obtain "planning permission" I got a form from town hall which my builder & I completed, paid a tax based on cost of materials (not labour). They then sent a town surveyor who approved my project, (she was in the house less than 5 minutes) The tax was about €60 on a bill of €1500, I guess to pay for the surveyor plus "admin"

Prior to all that my builder was fairly certain the project would be approved, as I recall main concern was the height of the room (has to be a minimum height to be approved as habitual, I have 2.50metre in mind but please check), plus ventilation & drainage. There's probably a minimum floor area spec as well.

If you are asking if a kitchen already installed would be approved, the seller should have already got the appropriate permission, that something your solicitor should ascertain, if there's no permission I'd expect the seller to obtain such prior to sale. 

Personally I wouldn't buy in the hope that I might get permission post-purchase, as you'll have problems selling when the time comes if you cannot get permission

Thank you for responding.  I have to give the agents an answer by tomorrow as to whether I am going to proceed.  

I would sooner be safe than sorry than have problems after I have completed.
