Hi all,

My husband and I are due to complete on a property in Duquesa on 2nd Sept.  Our lawyer has sent us a summary of all the fees, which we have now paid.

However, today (out of the blue) our lawyer was asking for 500 euros approx for the need to request boletín to change the electricity contract.  I challenged this cost as we have back and forth with the lawyer since Feb and this has never been mentioned.

The lawyer has now stated that wedo not have not to pay this now, and that they will let us know about this as the electrician has to visit the property to prepare an final estimate (after completion date).

I have no problem paying what is due, but is this normal ?

My assumption is that the current owner will take meter readings and send to either the lawyers or the electric company, but I don't know the system so I am a little confused and shocked by this charge.

Any advice would be much appreciated.

Also, I have asked the lawyer many times what the council rates bill dates are, the start and end date.  I know we have to pay between June and Sept, but in the UK our rates bill year is 1st April and 31st March.

And when is the non residential tax return due ?

In Spain unlike UK the utility company has a 'charge over the property and the owner', when you buy the property the debt passes to you, which would normally be the last part unpaid month, note that incudes water. The lawyer would need to ask for and check last monthly bills have been paid, but you might find if mid period you have to pay some of their use last period. It's not like UK where you get a meter reading and bill the new tenant, 'the charge is attached to the property'. The same will apply to the local property tax we call rates, IBI. They may have made a contract to pay the last month, the reason for the visit, (was it occupied?) the cost might be greater than to pick up the tab for the last part month. Perhaps now you understand how works you can sort with the lawyers.  

(The lawyers here normally charge a fee of about 1% of the sale price (a lot compared to UK) your deal really needed to include cover checking these things, changing suppliers utilities a pain here, they need to see the new deeds in your name to create a new charge over the property,, unlike UK nothing done on trust to pay bills or accept it's you on the phone, all ID and paperwork, also helps keep up employment for all the administration people)

To be fair the lawyers have been very good, and it is occupied and I have paid my part of the IBI and commnual charges.  They sent me a document stating there was no debt against the property and the English lady who lives there has been there for 21 years and seems to know her stuff.

I am happy to pay what we rightfully owe and I appreciate it all works different to the UK, but the 500 euros was an approx amount, which I noticed today was included in my friends fees (she is buying property next door) but not in mine.  I think I would prefer for them to do whatever they have to on completion and send me a bill for the exact amount and then we will pay.

It has not been the easiest process, and with me being a very over cautious Finance Manager, I have probably driven the lawyer crazy with all my questions and requests and wanting all my answers in writing, but I think it is too many years in Finance.
