If you are buying an older property you should always ask the selling agent for the ITE and the CEE (energy certificate) as 'the law requires them to be available when the property is being marketed and not just presented when the sale is being formalised at the Notary'. The age a property needing this varies, For example, Mijas requires the first inspection for properties as young as 25 years, Estepona is 30 years and every 10 years thereafter, whilst Marbella, located in between those Town Halls, is only after 50 years and every 10 years thereafter.

Many thanks, David, for this most useful information. Are there any other pitfalls we need to be attentive to?

Yes, make sure that back taxes due on the property have been paid.  You need a really good lawyer to protect you and even then you might find yourself surprised by unexpected back taxes a few years in after purchasing the property.  Funny how unpaid back taxes can just 'show up'.

Many grateful thanks for the warning!! Does this mean that you had to suffer from such a  "glitch"? Hopefully not.  Wishing you a great Sunday, best: Zaa

No not me personally but TWO of my neighbours.  One caught it the day before he signed (even though his lawyer had cleared the situation some time before) and the other neighbour just got the bill last week even though he bought the house 3 years ago.

How this happens is still a mystery to me so do not let a lawyer wave your enquiry off.  Make sure its in the Agreement documents that there are No outstanding tax bills to be paid on the property when you sign.

I hear many stories of lawyers not doing their due diligence in this regard so for that make sure its in writing.  Good luck!
