Hi, 

I have been considering purchasing a property in Spain but have my reservations over the process ...for instance it appears very risky to provide the vendor with a 10% deposit before the completion ... it seems to me that it would be very easy to disappear with the deposit at this point in the purchase .. and that there is no guarantee over this money ... are there any safeguards for paying over this money for instance a bank holding the money until completion etc ... any thoughts appreciated ...

Hi Rick.  I would recommend using a solicitor and making sure your vendor does too, then the deposit will be held with them.  We used Manzanares solicitors in AEG (above Sabadell bank) when we bought our property in March and would highly recommend them.  Good luck !

Hi rick. Just make sure you use a different lawyer to vendor and quiz there charges we use del Prado soliciters 150 yards below mercadona opposite side of road AEG they speak perfect English they are very professional and have sorted a few legal situations for us all perfectly.

Hi,

We bought in AEG and the 10% deposit rule went very smoothly.

We used Francisco Gómez solicitors in the same building as Viva estate agents and found them to be very professional.  They money is held safely in the Solicitors account and is not passed over until completion.

Also, do secure the services of a money broker we used Cambridge Global - it makes such a difference to the exchange rate you can secure.

It’s part of the process in spain but errors are made .

Your Solicitor should be instructed By you to hold the deposit in a neutral clients account 

And it is subject to a mortgage being agreed .( also the Survey ) 

On no account should the other party or the solicitor acting for the other party hold this money 

Also never use a solicitor recommended by the estate agent —— they need to be independent and acting only for your interest .
