We are 45 minutes from the famous Chris Stewart lol.
Basically the rules say you are allowed to be here 3 months in any 6 and a friend of mine who goes back and forth to work in the UK is being checked and passport stamped. But that is at Almeria which is much smaller than Malaga so I don't know if the same is happening there.
As far as Residency is concerned there are hundreds of brits running to the police stations to get their Residency that they didn't bother with before. Residency is the equivalent of The Settled and Pre Settled status you hear about for EU citizens in the UK. To date 1.7 million have applied and been granted settled or pre settled status in the UK.
Residency is first one for 5 Years (Pre settled) and then the second one is permanent (settled)
Both the UK and Spain talk about citizens rights being reciprocal. The UK have said no more EU citizens can come and apply as of Brexit day. The ones who are there it is said have until December 2020 to apply but that could change. So if it is reciprocal the Spanish will pull the drawbridge up on the same day. So anyone who has designs on being here permanently either sooner or later will have to have residency.
In the event of a no deal The Spanish Government have passed a Royal Decree which still need parliamentary approval because no-one can get a majority here but has cross party support in The Cortes. Things will continue uninterrupted for those here because it is Reciprocal with the British System. BUT the figure quoted by the Spanish Government is 300,000 Brits will be OK. That's the one's they know about (Residents) and why all the Brits here who have lived under the radar up to now are desperately trying to get an appointment at the Policia National to get Residency. The authorities are doing all they can to help making extra appointments available but you can imagine the strain that is putting on the system.
To get Residency you have to fulfil a couple of conditions. You have to have an address and preferably be on the Empadronamiento (The local town hall register). That is easy to do. Second you have to have 700 euros coming into a Spanish Bank account every month or have a Lump sum. I don't know what the lump sum is but the English Advisory Service in Torre del Mar will have more information. Thirdly you have to have health cover here so you are not a burden on the state. Over 65 that's easy with the S1 but under and Private Health cover is required. Now some say they take out the Private cover to go through the Application process and than cancel it when they've got the Residency so they don't have to pay every month. We pay 135 euros a month and get full cover except Medicines no extra charge. That's a matter you need to decide but having had to use the state system in an emergency once here for a couple of hours in hospital and some follow up wound dressing and hospital appointment it cost us 480 euros so I'm happy paying monthly.
