NIE to new TIE

Hi all hope all our members are well and healthy.  

I have arrived back on the Costa and wish to know more about the TIE . 

I have a green A4 NIE  and some years back a plastic id card. 

I have owned a property since 1998 and signed on the Padron in 2000 as a non tax resident.

I have received an updated  certificate for my Padron from Town Hall. 

I am a pensioner in the UK. 

I wish to know if I exchange my NIE for a TIE can I still be classed ASAP non tax resident. 

I own property in England  would this result in paying taxes in Spain should I choose to sell them .

If you can prove residence in Spain prior to end of 2020, you may be able to exchange your old green residence (sometimes referred to colloquially as the NIE) for a TIE. This would make you a resident of spain and after 6 months you will become a Spanish tax resident.

If you prefer to remain non-resident, your time allowed to stay in a Schengen area (Spain) is limited to 90 days in a rolling 180. Ownership of a Spanish property has no impact on the above.

Recommend you take legal advice on the current post-Brexit position.

You need some advice from and expert, this firm are accountants and deal with TIE https://cpgroup.business.site/

"If you can prove residence in Spain" then would be liable tax Spain in that period. You can't be a resident and non-resident. That's 'Schrödinger's cat'. Must be one place or the other. .
