Hello

FOR ANYONE THINKING ABOUT RETIRING TO SPAIN- CHECK TAX STATUS FIRST

I was hoping to retire to the Costa Del Sol as soon as I could sort out my "non-lucrative visa" here in the UK and the flights were back up and running.  However, now we have left the EU and you want to become a resident in Spain you will need to check your tax status.  I asked the question IF I SELL MY PROPERTY IN THE UK "HOW MUCH TAX WILL I HAVE TO PAY ON MY UK PROPERTY IF I BECAME A TAX RESIDENT IN SPAIN".  (I WAS ADVISED TO ASK THIS QUESTION)

The reply that came back was  IF YOU BOUGHT A PROPERTY IN THE UK IN 2004 FOR £150,000 AND ARE SELLING IT NOW FOR £250,000 - SPANISH CAPITAL TAX ON THE SALE WOULD BE APPROX 20,000 EUROS!!!!

HAS ANYBODY ELSE COME ACROSS THIS?  I WOULD BE INTERESTED TO HEAR FROM ANYONE ON THIS MATTER.

I would suggest that perhaps you sell your property in uk prior to applying for residency in Spain as there is a double tax agreement ? then perhaps if you are thinking of retiring to Spain the best idea would be to rent a place and look around to find an area and perhaps a property which meets your requirements (and consider the future where you may not have a car, not able to do plenty of steps /levels etc 

timing is important and get good advice 

Living in Spain gov website and spanish Citizens advice are good starting places

I would really suggest you speak to a professional lawyer/accountant before making any moves (anywhere in the world!) in regard to large sums of cash.  The taxation systems all over the world are becoming more onerous - regulation is increasing and so of course is the ability of governments to gain access to our data.  There is a tax treaty between the UK and Spain of course but there are so many grey areas and so many things that would be specific to your situation.  I do not know who said that to you about the 20k because they do not know your circumstances however capital gains taxation is something to be sure you understand in regard to your own circumstances.

You are very smart and wise to check on all this before blindly coming to Spain.  It is not like the glory days of old that is for sure.

There are many firms that specialize in helping British come to Spain.  Here is a link to some info which I am sure you have found already but maybe it helps.  Don't give up on your dreams but strategy and timing is key in this case.

As another reader has said get legal advice. My understanding is that it's best to sell the property before residenzia. However, if you sell it in the same Spanish tax year Jan to Dec you still have to pay capital gains tax as you've mentioned. If you are 65 years of age or over there may be an exemption. A friend of mine in similar position is going to sell UK property one calendar year then apply for Residenzia the following year to avoid capital gains. Good luck
