Power of attorney

Hi, can anyone give me any advice about getting power of attorney for English person living alone in Spain. All family are in Uk. Mum now 93 getting very frail (although of sound mind). We need to sort out payment for care for her (she lives at home at the mo and will be having daily help. She can no longer get to the bank, so we need to be able to access her accounts to pay fees. It seems to be a nightmare. Any advice (especially if you have personal experience) would be much appreciated.

Hi there,

I have no experience in Spain but expect similar situation to the UK.  First thing is the person themselves must assign a Power of Attorney and complete all the forms, sign etc..  So your mother must assign you as the PoA.  This is a very complex set of documents in the UK which you may already know but are available online.  Again, expect similar process to Spain.  Then, when the individual loses the capacity to care for themselves a doctor activates the PoA and you gain control over the individuals life only to make the best decision on their behalf, of course, that they would want for themselves. A PoA is like a Will, it sits there doing nothing until the person loses the capacity to make their own decisions.

You may be aware of all this from the UK so forgive me if I am telling you what you know already.  But I would really expect similar as in most Westernized countries you cannot just take control over a person's life without this activated PoA document signed by a doctor.  Its a tight process, and rightly so.

I surely hope your elderly mother is doing well as expected at her grand age.
