This message is to alert existing owners of apartments in PUERTO ALTO Estepona, which is supposed to be one of the best in the area, my aunt and uncle own an apartment in Puerto Alto, they are both mid 70's  they live in England, they went to Estepona in March to help my aunt recover from Chemo and Radiotherapy, they arrived in the evening and their apartment had been flooded, the bed was covered in black mould and they had to sleep on the sofas, all the bed linen had to be disposed of and the following day they had to go and buy all new bedding, the majority of their clothes had to be thrown out as they too were covered in black mould together with many household items including furniture.   They were exhausted when they departed, in July they asked friends to go and check it and they reported it had been flooded again, the community office of Puerto Alto wrote to them and advised the insurance provider had confirmed  the flood came from the apartment  directly above and that the insurance company Liberty of Madrid and their agente in Marbella had admitted liability.   They have contacted the owner and their insurers and to date none have replied, my aunt is hoping to have surgery soon and they intended her to recover in Estepona, they have been advised the apartment must be totally cleaned and redecorated again before they leave the UK. They have no choice but to have the work addressed, pay for it and then take action against the owner of the apartment who has been very rude to them, has anyone else suffered this problem in Puerto Alto.  They were told by other owners their apartments were flooded near them any advice or help would be appreciated.

The insurance companies normally sort this out, via the owner, if not you are going to have to instruct a Spanish Lawyer,

My aunt was a solicitor before she retired, she did mainly pro bono work for those injured and could not afford to pay a solicitor, when she retired she ceased her law society membership, when they bought the apartment in Puerto Alto they were told by the property solictor in Estepona the building was insured via the community and given they brought most of the furniture from their house in UK, thus it was second hand and did not have a great deal of value they did not need to pay for additional insurance.   The offending neighbour and the community maintenance manager of Puerto Alto were under the illusion my aunt and uncle were not protected because they did not have the addtional insurance, however the community office wrote to my aunt and uncle stating the insurers Liberty had admitted liability, they also receved an email from the offending neighbour claiming he had contacted his insurers based in Marbella asking when they were going to address the damage, my aunt wrote to the CEO of Liberty in Madrid, their agente in Marbella and the offending neighbour two weeks ago and non have replied.   My aunt is hoping to have surgery to remove the cancer and planned to recorver in the apartment , but they have been advised the place must be deep cleaned before they go and it would risk infecton for her!   Wat do you advise?

If the damage done by water from another apartment then their insurer would normally deal with this, the president of the community should be able to help. However, if not joy in the avenues you have pursued I see little choice but to speak to a lawyer, as I mentioned, you might be able to get a free consultation and them recover the cost from any damages if the other party is liable.

Puerto Alto community charge the earth for their fees, their service provided by a company named inmho, they took over from Villad, they do not reply to any queries.  Puerto Alto president does not pay cmmunity fees he claims he is not paid for his services to act as president, thus not paying fees is a payment for him!   Is he looking after the owners, I think not so when he approves all the work it increases the costs to the owners, but he is not affected.   The community of Puerto Alto has constant maintenance work for high costs to the owners!
