Note lawyers charge a lot more than UK on average 1% of the property price, don't pay more.

Take care you bid the right price, the market in Spain is poor. 

When creating a purchase contract, there are many kinds to use. Some of the most common include:

  • Reservation Contract
  • Option Contract
  • Private Purchase Contract ( deposit vs down payment contract)

Hi Dinx

Any lawyer in San Luis de Sabinillas will know La Duquesa because La Duquesa is part of San Luis de Sabinillas.

You could try Manilva Solicitors who have an office about 100 metres from the centre of San Luis de Sabinillas:

Or, Martínez-Echevarría, are a substantial firm I have used with several offices including Marbella who have recently opened an office in San Luis de Sabinillas:

Tread carefully because Spanish lawyers do not provide the same service or standards as UK lawyers and are not regulated in the same way.

Spanish lawyers do not normally handle the purchase funds, which are paid direct to the seller before a Notary, so you must not give your purchase funds to the lawyer.

Do not accept recommendations of lawyers from property developers or mortgage brokers because those lawyers tend to act in the best interest of that property developer or mortgage broker ie ensuring the sale proceeds and the property developer and/or mortgage broker receives his or her commission.  Been there, done that, got the T-shirt!

Also bear in mind that planning permission is not regulated in the way that it is in the UK so that, if there is space between your home and the beach, someone probably can and will get permission to build there and potentially to block your view.  Been there, done that, got the T-shirt!

That is the advantage of a 'front-line beach' property, provided it is not so close that the land is publicly owned, and you can find 'front-line beach' homes in or just outside La Duquesa marina, just next to the public path.

They often they use a special agreed account controlled by lawyers, 'so the money is not paid direct to the seller'.  Also note it varies from area to area but properties over a certain age need a building survey certificate. 'ITE' The agent should not sell without this in place.  'Municipalities have been given the right to reduce the period below 50 years and add further renewal inspections. For example, Mijas requires the first inspection for properties as young as 25 years, with another inspection 15 years later at 40 years, and then every 10 years thereafter. Estepona is 30 years and every 10 years thereafter, whilst Marbella, located in between those Town Halls, is only after 50 years and every 10 years thereafter' ITE

Hi, I used Gibro Abogados Lawyers who are English speaking and based in Duquesa to purchase my property in Duquesa last year and everything went through without any problems. Hope this helps and all the best.
